Draft Resolution on the Crisis in Darfur

 

 

General Assembly 6th - Legal

 

Reaffirming commitment to the sovereignty, unity, territorial integrity, and independence of Sudan as consistent with the Machakos Protocol of 20 July 2002 and subsequent agreements based on this protocol as agreed to by the government of Sudan, 

Condemning all acts of violence and violations of human rights and international humanitarian law by all parties to the crisis, in particular by the Janjaweed, including indiscriminate attacks on civilians, rape, forced displacement, and acts of violence especially those with an ethnic dimension.

Expressing its utmost concern at the consequences of the conflict in Darfur on the civilian population, including women, children, internally displaced persons, and refugees.

The General Assembly;

  1. Acknowledges that the crimes being committed in Darfur are acts of genocide, in accordance with the Convention on the Prevention and Punishment of the Crime of Genocide ( 9 December 1948), specifically as it defines genocide as;

"…any of a number of acts committed with the intent to destroy, in whole or in part, a national, ethnic, racial or religious group: killing members of the group; causing serious bodily or mental harm to members of the group; deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part"

  1. Demands that all hostilities cease immediately;
  2. Supports an African Union-led coalition to ensure compliance with said ceasefire;
  3. Calls for the implementation of a UN led peace-monitoring group whose mandate is to supervise situations without forceful involvement, irregardless of the situation;
  4. Requests the support of all United Nations members in the endeavor to maintain peace;
    1. Requires the creation of a United Nations Humanitarian Emergency Relief Fund (UNHERF), charged with the task of providing humanitarian assistance to the people of Darfur
    2. UNHERF will be subsidized by the contribution of 0.25%GDP of all UN member states, and contributions will be for a 5 year period, with the size of the contribution to be renegotiated at the end of the 5 year term.
  5. Urges the government of Sudan to accept the cooperation of, and provide protection for, international humanitarian relief organizations;
  6. Condemns the actions of all individuals that have taken part in the genocide of Darfur ,
    1. Insists that all nations agree to international extradition agreement whereby all perpetrators will be brought to justice regardless of the state that is harboring them;
    2. Any state found to be harboring an accused perpetrator of the crime of genocide will face immediate economic sanctions, and will face possible expulsion from the United Nations, to be determined by the General Assembly.
    3. All perpetratoes will be prosecuted in the International Criminal Court (ICC), in accordance with the terms outlined in the Rome Statute of the International Criminal Court (1 July 2002)  
  7. Requires the immediate action of the United Nations Security Council if such demands are not complied with, and to consider the use of Chapter 7 of the United Nations Convention allowing the current situation in Darfur to be brought to a peaceful resolution by force.
