The question of the reunification of Cyprus

 

THE GENERAL ASSEMBLY,

 

Recalling all relevant resolutions on the question of Cyprus , especially resolution 3212 (XXIX) as of 1st November 1974, in particular clauses 1, 2,3,4, 5, 6, 7, 9 and 10,

 

Gratefully thanking the Secretary General, Kofi Annan, and his special advisor for Cyprus , Alvaro de Soto , for the establishment of the Annan Plan,

 

Taking note of the assessment of the Secretary-General that the security situation on the island has become increasingly benign over the last few years and that a recurrence of fighting in Cyprus in increasingly unlikely,

 

Regretting- the failure of the referendum set on the people of Cyprus on 24 April 2004 which would have enabled the accession of a joint Republic of Cyprus into the European Union (EU) on 11th May 2004, concerning the Cyprus Issue,

 

Further regretting that the "green line" between the two Cyprus ' will be an external border of the European Union, and thereby bisecting an island, unless reunification talks continue,

 

Stressing the importance of the right of safe access for all Cypriots to all parts of Cyprus , whatever their ethnic origin, as a result of a future ratification of the Annan Plan,

 

Expressing gratitude to the Government of Cyprus and the Government of Greece for their voluntary contributions to the funding of the UN Peacekeeping force in Cyprus, and to the Government of Turkey for changing its policy on Cyprus and displaying an open and cooperative attitude towards the conflict,

 

Guaranteeing the support on matters such as implementation of this resolution,

Reaffirming the Zurich agreements with its Treaties of Guarantee, of Alliance and of Establishment,

                       Emphasizing with special commitment the main articles of the

                       Annan Plan, in particular i - v,

1.  Asks the Secretary General (SG) to reassess the Annan Plan for a settlement in Cyprus, which should focus on ideas that change the Comprehensive Settlement of the Cyprus Problem (CSCP) such that:

a.   The Turkish Republic of Northern Cyprus (TRNC) will be internationally recognized as a federal state of the Republic of Cyprus , such that:

i.    The membership of parliament will be extended by electoral districts defined by the International Court of Justice (ICJ-), rather than ethnic identity,

ii.   The head of state of the unified Cyprus government be represented by two positions, a President and a Prime Minister, upon initial adoption of this new system, power sharing negotiations will be held between the head of state of Greek Cyprus, and that of the TRNC, to determine the roles of each position, and which of the two representatives will claim either of said positions for the initial term,

b.   According to international laws and the recommendations of the commission appointed by the

Secretary General to revise the CSCP, the TRNC will have executive power separate to that of the Republic of Cyprus, but one judicative and legislative power: this process will start in 2009,

c.   The government of the TRNC will have control over certain internal aspects which are to be determined by the Geneva round, such as:

i.    Independent financial and currency laws,

ii.   Following the Cyprus federal governments foreign policy, and foreign relations conducted in accordance to it, however, allowing for freedom of foreign trade provided it does not conflict with standing foreign policy,

in.   the right to independently recruit and train police,

iv.  Temporarily allowing the right to maintain Turkish Cypriot military personnel in the country until 2010, whereby only 30% of the standing military is allowed to be maintained as a reserve,

d.   A new referendum will be announced in 2008, which will come into action on 1 January 2009

if it is accepted with a 50 percent majority by the people of Northern and Southern Cyprus ;

2.   Calls for the newly created joint federal government to consider working towards,

a.   a joint executive body by 2014

b.   a joint finance and currency law by 2Ol4

3.   Strongly urges both sides to take measures, in order for a general rapprochement, such as:

a.   Educational programs:

i.    The introduction of Greek as a foreign language in all secondary junior schools and junior high schools in the TRNC,

ii.   The revision of the history syllabus of all school systems with the aid of the International Bureau of Education (IBE)

b.         Information campaigns   

i.    Reform of media censorship

ii.   Special media campaign which objectively informs the people about the ideas of the revised CSCP

c.   Cultural programs:

i.    Establishment and celebration of national and religious days and holidays,

ii.   Campaigns for the unification of separated families,

iii. Establishment of inter-communal social events, such as

1.   Study trips for students,

2.   Excursions to musical, theatrical, sports or other social events,

iv.  Information campaigns of cultural differences and similarities,

 

4.   Resolves that the United Nations Educational, Social and Cultural Organization (UNESCO) and the IBE shall be responsible for aiding the two sides in their efforts defined in clause 3 a. and supervising the progress;

 

5.   Urges both people, the Turkish Cypriots and the Greek Cypriots to accept the revised CSCP;

 

6.   Recommends both governments, the government of the republic of Cyprus and the TRNC to support and encourage her people to support the revised Annan Plan;

7.     Calls upon all states and institutions to withdraw all its armed forces and military presence and personnel in accordance to Article 2, paragraph I and 4 of the Charter of the United Nations;

8.     Requests that both Cyprus and the Turkish republic of Cyprus begin to withdraw their armed forces currently stationed along the UN buffer zone at the same time, and begin gradual decommissioning and disarmament of their military in all other locations on the island, in a phased process, in order to lessen tensions between both sides, under the supervision of UN peacekeeping forces in the area, all this to take effect in the following phases:

 

a.   A four month time period for complete withdrawal from any positions within 10 miles of the UN buffer zone,

h.   A 10 % military personnel downsizing by 2005, to be overseen and inspected by UN inspectors ,

c.   A 20 % military personnel downsizing by 2006, to be overseen and inspected by UN inspectors,

d.   A 30 % military personnel downsizing by 2007, to be overseen and inspected by UN inspectors,

e.   Complete decommission and relocation of Turkish combat troops from the TRNC by the end of 2008,

f.    Joint military force regrouping Republic of Cyprus military and TRNC military; this process is to be finished by 2012

g.   A 60% military personnel downsizing by 2015 of the joint governmental military force, to be overseen and inspected by UN inspectors,

h.   A reserve force of 30% of the current number of military personnel allowed to be maintained from thereafter;

i.          The lifting of military restrictions after 2030;

 

9.   Asks the Security Council that all 1200 UNFICYP personnel be maintained on the LTN buffer zone to oversee the gradual demilitarization of standing Cyprus military factions as laid out in clause 8, and continue discouraging any reoccurrence of conflicts and that their mandate be extended to a period deemed fit by the Republic of Cyprus, yet there will be an increase in:

a.   The UN civilian affairs workers by 180 units,

h.   The LN civil police force by approximately 200%, in detail to be determined by the Security Council;

10.   Further asks the Security Council to change the tasks UNFICYP to internal peacekeeping operations in cooperation with both autonomies, the Republic of Cyprus and the TRNC, starting from 2015 upon request of the joint federal government of the republic of Cyprus ;

11.   Urges Turkey and Greece to accept the sovereignty of the Republic of Cyprus and that military interference or any other form of interference is under no circumstances acceptable, and to that end

12.   Further urges the Security Council to revise the Treaty of Guarantee in accordance to clause 11;

13.   Strongly affirms the already granted support of the TRNC through the EU by 259 million USD as a reaction to the outcome of the referendum in Northern Cyprus and transmits to EU members, as well as all other UN members, the duty to actively observe the progress and the implementation of this resolution;

14.   Considers that in a unified island all internally displaced persons, before 1980, should, if they so choose to, be able to return to their homes in safety and calls upon all parties concerned to undertake urgent measures to that end;

15.   Reiterates the issue of missing persons and illegal refugees in Cyprus and asks the GA 3 committee to add this issue to the agenda;
